High Speed Chase Turns Deadly After Suspect Goes After Trooper's Gun

NORTH HUDSON, N.Y. -

After a shoot out with police, a New York man is dead. 28 year old Richard Aubin was killed by police after leading troopers on a high speed chase last night.

It started on 87 South in Schroon Lake, lasted 25 minutes, ending on Route 9 in North Hudson.

Police say the man behind the wheel, who led police on a one hundred mile per hour pursuit, has an extensive criminal history in New York and although it's an unfortunate situation, police are glad it wasn't one of their own who was shot.

Crime scene tape lined the edge of the woods just off Route 9 in North Hudson New York. It's where a high speed chase came to an end, forcing officers to shoot and kill 28 year old Richard Aubin of Ausable Forks.

"The New York State Police are investigating what appears to be a justifiable use of deadly physical force," New York State Police Captain Robert LaFountain said.

John Haina was in Schroon Lake and witnessed the 2005 Chevrolet pickup truck tear through town around 5 Tuesday night.

"He had it matted right to the floor because the truck was making quite a bit of noise," Haina said.

Speed is what a New York State Police Trooper was initially pulling Aubin over for.

"Well over a hundred miles an hour," Haina said.

Well, that routine traffic stop turned deadly when Aubin refused to stop and exited 87 South, headed for Route 9 North, hit a spike strip, then got out and ran about 75 yards into the woods.

"Two troopers chased the suspect on foot into the woods where they encountered the suspect who violently resisted arrest," Captain LaFountain said.

Police first tried pepper spray, but when that didn't work, they say Aubin assaulted a trooper and tried to get her gun. That's when several shots were fired from another trooper who was standing nearby.

"It was just chaos last night," Haina added.

Aubin's past convictions include robbery, assault, DWI and he has a history of resisting arrest.

"He has spent time in New York State Prison and he is a convicted and violent felon," Captain LaFountain said.

This case is still under investigation, but the two troopers who were involved are still on active duty.

An autopsy was scheduled for tonight to see if Aubin had drugs or alcohol in his system.
