ST. ALBANS, Vt. -
Police say an odd fight between two neighbors, ended in a stabbing in St. Albans. And one man is accusing the other of raping him.
180 Federal Street was quiet Friday afternoon but at 3:40 Friday morning St. Albans police had to break up a fight there between 21 year-old Corey Worthen and 34 year-old Joseph Devino and one other unidentified person. Police say it ended with Worthen stabbing Devino.
"The individual left the house, came back with a steak knife and stabbed him in the head," St. Albans Police Chief Gary Taylor.
We went to the scene where this all happened and it turns out that Worthen lives upstairs from Devino and had come downstairs to hang out with Devino, who lives below him.
Devino told police that the fight started because Worthen had tried to rape him. But Worthen doesn't see it that way.
"They jumped me and they just tried to make a good excuse why they did it," Worthen told us outside his apartment.
Worthen says that excuse, that he tried to rape Devino, is laughable.
"(Laughs) I don't know that's hilarious. I don't know how I could do that with him and his friend there," Worthen said.
We tried speaking with Devino as well but he wasn't home.
"There's a real dispute about the he said-he said stuff," Chief Taylor said.
Devino's injuries are not life threatening but he did receive medical treatment. Worthen was put into detox after the fight.
According to the Franklin County prosecutor neither will be charged for the assault at least until their investigation is completed, including whether Devino was sexually assaulted.
Devino appeared in court Friday for Simple Assault charges separate from his altercation with Worthen. While Devino was receiving medical treatment after the fight police say he assaulted an X-Ray technician.
