A federal appeals court is going to hear oral arguments next month on the Vermont case that tests the limits of a state's authority to regulate nuclear power.
The case that will be heard by the 2nd U.S. Circuit Court of Appeals in New York involves the long-running attempt by the state of Vermont to close the Vermont Yankee nuclear plant.
Last January, Entergy Vermont Yankee won a lower court ruling that struck down a state law that gave the Legislature a say in whether the plant could be re-licensed.
Vermont Public Radio is reporting oral arguments will be held on Jan. 14 in New York.
