BURLINGTON, Vt. -

Gun shots shake the Old North End neighborhood in Burlington and not long after police have a man in custody and charged with attempted second degree murder.

It was early 2 AM Saturday morning that police received reports of gun shots in the Old North End. No one was killed or seriously hurt. Police are charging nineteen year old Andrew Dashno with attempted second degree murder.

At the intersection of Peru St. and Johnson St. a fight started up between Dashno and a 39 year old man who police have not identified.

Police say that while the two were fighting the unidentified person was carrying a gun that fell loose on the street.

"I believe it was in a pocket like a sweatshirt pocket but it fell out," Burlington police LT. Scott Davidson said.

Police say that's when Dashno picked up the gun and fired two shots at the man he was fighting, hitting him in the leg. The gun was loaded with shot shells that are more commonly used with shotguns than handguns. The man was hit with pellets but received only minor injuries.

"When officers arrived they had met with the victim the victim advised he had been shot at by a suspect who was later identified as Andrew Dashno," LT. Davidson said.

Dashno was found by police a short distance from the crime scene and charged with attempted second degree murder. the man he was fighting has not been charged by police which angers some people in the neighborhood who say they saw the fight.

They wouldn't speak on camera but said the man Dashno was fighting repeatedly struck him with a baseball bat and pulled the gun on Dashno.

The police report did not specify how the fight started or if the unidentified man assaulted Dashno with any weapons.

But even people who did not witness the fight were upset by the evolving nature of their neighborhood.

"It's really unfortunate you know the crime in this town is really rising and that's unfortunate as well," neighborhood resident Isaiah Law said.

Police said that Dashno was cooperative when he was taken into custody near the crime scene but when he was being charged became more violent. He picked up an additional charge of simple assault on a police officer when he spit at a police officer. Dashno is scheduled to appear in Chittenden Superior Court on Tuesday November 13th.
