Texting and Driving Victim Testifies in Court

BURLINGTON, Vt. -

With the cast on her right arm, Deborah Drewniak answered questions Wednesday in a Burlington courtroom.

"I don't remember anything that happened to me," said Drewniak.

More than a year ago police say Drewniak, and her dog were hit by Emma Vieira, who they say was texting and driving.

While Drewniak suffered severe injuries, the hardest part of accident she says was losing her dog.

"Charlie was my best friend," said Drewniak.

Drewniak's neighbor, Krisie Farrington, also testified.

Prosecutors played her 911 call from that August night.

"Can you tell me if the person is breathing?" said a 911 operator.

"No, no I can't see," said Farrington.

Cell phone records were also displayed, showing six text messages Vieira sent and received around the time of the accident.

Records police say it took a subpoena to get because Vieira tried to hide evidence.

"I did not see any text messages on the phone when I looked at it briefly after she unlocked it," said Colchester Police Sgt. Detective Charles Cole.

The defense admits Vieira was texting, but says it happened before the incident.

It also says Drewniak's dark clothing and poor lighting contributed to the accident.

Plus the defense says witnesses who saw Vieira driving, didn't think she was doing anything wrong.

"A lot of people tend to speed by but I didn't notice any speeding," said Farrington.

The defense plans on putting a number of reconstruction experts on the stand.

As far as putting Vieira there, they say that's highly unlikely.

The trial is expected to last until the end of the week.

If convicted, Vieira faces 15 years behind bars.
