MONTPELIER, Vt. -
Experts expect President Barack Obama to easily win Vermont but that would be hard if he's not on the ballot.
That could happen if a Vermont man wins his recently filed lawsuit against the president.
This case was filed by H. Brooke Paige. He's the man who lost the Vermont republican primary for U.S. Senate.
"For the past several years, I've been aware that Mr. Obama was not qualified under the Constitution," says Paige.
Which is why Paige says he did a lot of research into U.S. history.
"He failed to meet De Vattel's definition of Laws of Nations which was used by the founders and framers," says Paige.
Paige filed a lawsuit to keep Obama's name off the Vermont ballot, which he says has nothing to do with the birth certificate controversy.
"There are 100 things you can come up with that aren't the issue. The issue is very simple. Were both his parents citizens at this time of birth?" says Paige.
The president's father was not a U.S. citizen. Paige says that means Obama is not a "natural born citizen", which is a qualification for president.
Vermont's Attorney General's Office says it is going to fight this and it says there's a long history of these types of lawsuits failing.
Across the U.S., several judges rejected similar "natural born citizen" lawsuits. They say simply being born in the U.S. is enough and who your parents are is not important.
"My hope is that we will win," says Paige.
Paige wants his lawsuit heard soon before the ballots are printed. The secretary of state says they are just waiting for the results of the progressive governor's primary before the ballots are printed.
