Plattsburgh, NY - New York's Attorney General is suing 16 head shops, including one in Plattsburgh, for selling products the AG considers dangerous and deceptively labeled. The products include different forms of synthetic marijuana and bath salts, both linked to seizures and even death.
"I have not sold bath salts. I would never carry bath salts. And synthetic marijuana, I do not have a clue of even what they're referring to," Carla Brotherton said.
Brotherton is the owner of two shops that the AG is investigating. She claims she has never sold anything illegal. But, Attorney General Eric Schneiderman says, it is not the product that is illegal but how it is labeled.
"Under New York's labeling law, you have to provide information about the manufacturer, packer, or distributor of a product. You have to provide an accurate description of the quality of the product and you have to provide warnings," Schneiderman said.
To make matters more complicated, some forms of bath salts and synthetic marijuana are illegal and others are not. In the Spring the New York Assembly tried to pass a bill making all forms of both drugs illegal. The bill did not end up passing the Assembly.
