Brooke Bennett's Family Reacts to Michael Jacques' Trial Date

BURLINGTON, Vt. -

Lucinda Milne had a hard time keeping her emotions in check Friday as she walked out the federal courthouse in Burlington.

"Right now I'm kind of upset," said Milne.

It's an all too common emotion for Brooke Bennett's grandmother.

Milne came to the Burlington courthouse to learn when Michael Jacques, who police say kidnapped, raped and killed the 12-year-old, would finally be put on trial.

Nearly four years to the day, attorneys met to discuss when that would happen, while Jacques remained in his cell.

After debating for nearly 45 minutes both sides decided on September.

But not this coming fall, September of 2013.

"That sounds like September 2050," said Milne.

That means Bennett's family will have to wait more than five years before they get its day in court.

"There ain't too many families that could go through what we're going to and stay together," said Milne.

The case has been delayed for years.

Last year, it was pushed back after prosecutors decided to pursue the death penalty.

A motion that's currently under review.

Then, the Judge William Sessions tried to start in February, but the lead defense attorney told said that wouldn't work with his schedule.

Once a trial does begin, Judge Sessions say it could take four months, because of the publicity the case has received.

But for Milne, she just wants justice, and says she thinks about Bennett all the time.

"Everyday of my life," said Milne.

A ruling on whether Jacques will face the death penalty is expected this fall.
