Vt. Court: Time Off Doesn't Accrue During Leave

MONTPELIER, Vt. -

The Vermont Supreme Court has ruled that state employees can't accrue paid time off during unpaid family  leaves.

Ursula Stanley, an employee of the state Transportation Agency took a maternity leave in 2007. Had she been working, she would have accrued 29 hours of vacation time and 29 hours of paid sick time during the period of her leave.

The state told her she didn't have that accrued time coming, and she complained to the Human Rights Commission. The commission sided with her. But on Friday, the Vermont Supreme Court sided with the state.

That means Stanley cannot be credited with accrued vacation and sick time during the period she didn't work.
