Vermont Court Upholds Conviction in Stray Bullet Death

BURLINGTON, Vt. -

A Vermont man convicted of involuntary manslaughter for the stray-bullet death of a St. Michael's College professor has lost his appeal to the Vermont Supreme Court.

On Friday the court upheld the conviction of Joseph McCarthy, of Essex, who was sentenced to two years in prison in 2010 in the September 2008 death of neighbor John Reiss.

Reiss was shot while he was sitting down to dinner in his home by a stray bullet from a backyard firing range.

Police never determined who in the group of men who were shooting fired the fatal bullet. Prosecutors said McCarthy was reckless in setting up the range and should be held liable. A second man also was convicted of involuntary manslaughter and was sentenced to 60 days in jail.
