US Sen. Blumenthal & Schumer Facebook Password Requests May Be Against Federal Law

WASHINGTON -

U.S. Senators Richard Blumenthal (D-CT) and Charles E. Schumer (D-NY) are asking the Equal Employment Opportunity Commission and Justice Department to see if employers asking job seekers to turn over social media and email username and passwords violates Federal law.

According to a press release, Blumenthal and Schumer raised concerns over requiring applicants to provide login credentials to social networking sites and acquiring private protected information that may influence hiring decisions and lead to unlawful discrimination against otherwise qualified applicants.

"Employers have no right to ask job applicants for their house keys or to read their diaries – why should they be able to ask them for their Facebook passwords and gain unwarranted access to a trove of private information about what we like, what messages we send to people, or who we are friends with?" Charles Schumer said in a press release. 

Blumenthal and Schumer sent letters to the Equal Employment Opportunity Commission and Justice Department addressing their concerns over the practice.

Blumenthal and Schumer are also drafting legislation that would seek to fill any gaps in federal law that allow employers to require personal login information from prospective employees to be considered for a job.

Facebook released a statement Friday against the practice and said it was in violation of Facebook's Statement of Rights and Responsibilities to share or solicit a Facebook password.
